Biographical Statement

After practicing lawyer for 32 years -- 20 years as a trial lawyer in private practice (AV-rated by Martindale-Hubbell), and 12 years as corporate counsel for NIKE, Inc. -- I began serving exclusively as an arbitrator and mediator of complex commercial, intellectual property, employment and sports business disputes. I have since served as an arbitrator or mediator in numerous commercial and other matters, including:

  • Actions arising out of sports marketing endorsement and/or management relationships
  • Dispute regarding the use of a trademark under a trademark licensing agreement
  • Breach of a timberland acquisition contract
  • Dispute between two non-profits regarding leased space
  • Claim by a prisoner for violation of his civil rights
  • Dispute between competing bidders for the right to operate hotel property
  • Claims arising out of dissolution in a family agri-business
  • Contractual disputes in professional service industries
  • Disputes between partners in a medical partnership
  • Securities claims
  • Buyout and termination of executive leadership in a closely held commercial enterprise

In 2020, I was appointed by Governor Kate Brown to serve as the mediator in the successful historic negotiation between Oregon's timber and environmental interests in an effort to forge a new approach to logging Oregon's private timber lands. I am a member of the Commercial Panel of the American Arbitration Association, a panel member of the International Centre for Dispute Resolution (ICDR), and have been AAA-trained in mediation.

Throughout my legal career, I handled commercial disputes of almost every stripe: serving as lead trial counsel, or managing others as lead trial counsel, or advising a multi-national Fortune 150 company (NIKE). This included numerous significant intellectual property matters involving trademarks, utility patents, design patents and copyrights.

In addition to the breadth of substantive commercial and sports legal experience, I bring the seasoning that derives from the diversity of venues in which I have practiced: a small plaintiff-oriented litigation boutique in Seattle (MacDonald Hoague & Bayless), a large commercial general practice firm in Portland (Tonkon Torp), and an in-house legal department of a multi-national company.
